GOC legislation

In addition to the Government Owned Corporations Act 1993 and associated Government Owned Corporations Regulation 2004, GOCs are also subject to other specific legislation. A summary of other legislation, including public sector legislation, and whether it applies to GOCs, is set out below.

Corporations Act 2001  Applies
Public Service Act 2008  A GOC is a relevant EEO agency for Public Service Act 2008, chapter 2. Otherwise does not apply.
Public Sector Ethics Act 1994 Does not apply
Right to Information Act 2009 Applies to all GOCs, except where otherwise specified in the Act or in the Infrastructure Investment (Asset Restructure and Disposal) Act 2009.
Judicial Review Act 1991 Does not apply to "excluded" commercial activities and "prescribed" CSOs
Crime and Misconduct Act 2001

Crime and Misconduct Act 2001: Applies to the extent prescribed in section 156 of the GOC Act. Does not apply to GOCs that are declared entities under the Infrastructure Investment (Asset Restructuring and Disposal) Act 2009)

Financial Accountability Act 2009 

Applies to extent prescribed in the GOC Act and GOC Regulations.

Financial and Performance Management Standard 2009 
(subordinate legislation to Financial Accountability Act 2009)

Ombudsman Act 2001  Does not apply
