GOC Policies and Guidelines

In addition to requirements under the Government Owned Corporations Act 1993, such as preparing a Statement of Corporate Intent (SCI), Corporate Plan, and Employment and Industrial Relations Plan, the following represents a list of other Queensland Government policies and guidelines that currently affect government owned corporations (GOCs).

This Code of Practice for GOCs outlines approval requirements and guidelines for entering into financial arrangements. The Code includes competitive neutrality fee (CNF) arrangements. The Code applies to all GOCs and their subsidiaries (except for QIC Limited).
Code of Practice for the Building and Construction Industry (Department of Justice and Attorney-General website) March 2012 - view yes
This Code of Practice establishes standards for matters such as Workplace Health and Safety, security of payment, employment and industrial relations. Cabinet decided that all GOCs should comply with the Code. All corporations were notified of their obligations by shareholding Ministers, under Section 114 provisions of the GOC Act and GOCs are asked to observe this Code from 1 July 2001.
Corporate Entertainment and Hospitality Guidelines September 2008 pdf download (50 K) yes
These guidelines provide a framework for GOCs to develop and implement their own policies to manage corporate entertainment and hospitality in line with the Government's expectations.
Corporate Governance Guidelines for Government Owned Corporations February 2009 pdf download (220 K) yes
These guidelines provide a framework for GOCs to develop, implement, review and report on their corporate governance arrangements. The guidelines set out general principles of good corporate governance, with a number of recommendations to give effect to each of the principles.
Cost of Capital Principles - Government Owned Corporations February 2006 pdf download (210 K) yes
The Cost of Capital Principles provide a framework for the calculation of cost of capital for Government Owned Corporations (GOCs). This policy paper does not apply to those business areas within GOCs which have their cost of capital regulated by an independent entity.

These guidelines set out the key principles for GOCs to adopt when undertaking investment, ensuring that shareholding Ministers’ requirements are met while still enabling GOCs to pursue commercial effectiveness in their business activities and enhance shareholder value. The guidelines have recently been refocussed to succinctly and more clearly define shareholding Ministers’ requirements and emphasise the importance of risk management for GOCs.

These guidelines set out the key issues for GOCs to consider when contemplating entering into Joint Venture agreements to ensure arrangements are structured to most effectively pursue GOCs’ commercial objectives without impinging the State’s ability to manage its asset risk over time.
Key Shareholder Requirements for Constitutions 2006 pdf download (25 K) yes
The following document is a guide for GOCs to use, to facilitate shareholding Ministers approvals relating to GOC subsidiaries such as approvals of the establishment of a new subsidiary with a constitution and the to alter a constitution. Please note - this policy is currently under review.
Local Industry Policy: A fair Go for Local Industry (Department of Employment, Economic Development and Innovation website) October 2010 pdf download yes
This policy was developed to ensure local industry is given fair and reasonable opportunity to be considered for major project work being undertaken in Queensland. The policy has particular requirements for GOCs, such as annual reporting to the portfolio Minister on local industry involvement in projects over $5 million and the preparation of an Industry Participation Plan for projects also valued over $5 million.

Queensland Port Government Owned Corporations - Local Government General Rates Equivalents Regime: Guidelines for Assessment, Collection & Payment* June 2000 pdf download (35 K) yes
The Queensland Government decided on 10 May 1999 to establish a regime for the collection of general rates for strategic port land in commercial use by port GOCs. Local government general rates equivalents on strategic port land in commercial use took effect for port GOCs from 1 July 1999.
State Procurement Policy (Department of Housing and Public Works website) September 2010 pdf download yes
The State Procurement Policy requires Government agencies to use their purchasing activities to advance Government priorities, achieve value for money, and ensure probity and accountability.
